Donation Terms

ASSOCIATION CORAL GARDENERS

1. Purpose

These Donation Terms govern donations made for the benefit of Association Coral Gardeners (the “Association”) through the website www.coralgardeners.org (the “Website”).

They specify in particular the arrangements for making donations, their allocation, processing and the conditions applicable to any recurring donations.

Donations made for the benefit of the Association are separate from the products and services marketed by Coral Gardeners SARL, including coral adoption programs, products from the store and experiences or eco-tours, which are subject to their own General Terms and Conditions of Sale.

The donations covered by these terms are made for the benefit of:

3. Nature of the Donation

A donation constitutes a voluntary contribution made without commercial consideration for the benefit of the Association in order to support its public-interest missions and activities.

The donation does not confer any right of ownership, possession or decision-making over the corals, nurseries, equipment, programs or other assets of the Association.

Where content, information or communications are sent to donors for informational or thank-you purposes, they do not constitute commercial consideration for the donation.

4. Amount and Donation Arrangements

The donor freely chooses the amount of their donation from among the options offered on the Website or, where such an option is available, by entering an amount of their choice.

The Website may allow:

• a one-off donation;
• a recurring donation, including monthly, where this option is offered.

The total amount and any frequency of the donation are indicated to the donor before final confirmation.

5. Payment

Donations are paid using the payment methods offered on the Website.

Payment processing may be handled by a secure third-party provider, including Donorbox and/or associated payment providers.

The Association does not directly receive the donor’s confidential banking information where such information is processed by these service providers.

The donation is deemed to have been made upon confirmation of payment.

6. Recurring Donations

Where a donor chooses to make a recurring donation, they authorize the debit of the amount and at the frequency indicated at the time of subscription.

The donor may stop their recurring donation at any time in accordance with the methods offered in their Donorbox account or by contacting the Association at: support@coralgardeners.org

Termination of the recurring donation will take effect for future debits and will not result in reimbursement of donations already made.

7. Allocation of Donations

Unless a specific allocation is expressly offered and selected by the donor, donations are allocated to financing the missions and activities of Association Coral Gardeners in accordance with its statutory purpose.

They may in particular contribute to financing coral restoration programs, scientific activities, awareness-raising actions, equipment, teams and, more generally, the resources necessary to carry out the Association’s missions.

Where a donation is expressly allocated to a particular program or project, the Association will endeavor to use it in accordance with that allocation.

If the relevant project cannot be carried out, has been completed or if the amounts collected reasonably exceed the identified needs, the Association may, in compliance with applicable law and the donor’s intention, allocate the funds to a program pursuing a similar purpose or to its other public-interest missions.

8. No Commercial Consideration

A donation made for the benefit of the Association is independent of any order or purchase from Coral Gardeners SARL.

Any offer including a service or substantial commercial consideration is identified separately on the Website and is subject, where applicable, to the General Terms and Conditions of Sale of Coral Gardeners SARL.

9. Receipts and Tax Benefits

Where applicable legal and tax conditions are met, the Association may issue the donor with a receipt or supporting document relating to the donation made.

However, making a donation does not, in itself, guarantee the existence of a tax benefit.

It is the donor’s responsibility to verify their eligibility for any tax scheme, in particular in light of their personal circumstances, place of residence and the regulations applicable to them.

The Association does not provide individual tax advice.

10. Payment Error and Refund

In principle, a validly made donation is final.

However, in the event of a manifest error, duplicate payment or unauthorized transaction, the donor is invited to contact the Association as soon as possible at support@coralgardeners.org, providing information enabling the relevant transaction to be identified.

Each request will be considered on a case-by-case basis. Where a refund is granted, any tax receipt or supporting document issued in respect of the relevant donation must be cancelled or returned in accordance with the instructions provided by the Association.

11. Donation Made by a Third Party

The donor warrants that they are authorized to use the payment method used to make the donation.

Where a donation is made on behalf of a legal entity or a third party, the donor warrants that they have the necessary authority to act on its or their behalf.

12. Personal Data

Personal data collected in connection with a donation is used in particular to process payment, carry out administrative and accounting follow-up of the donation, communicate with the donor and, where the applicable conditions are met, issue the corresponding supporting documents.

The arrangements for processing personal data are detailed in the Privacy Policy available on the Website.

In connection with donations made for the benefit of the Association, Association Coral Gardeners acts as data controller for the processing activities that it determines.

13. Amendment of These Terms

The Association may amend these Donation Terms, in particular to adapt them to changes in its activities, the Website or applicable regulations.

The applicable version is the version available on the Website at the time the donation is made.

14. Applicable Law and Complaints

These terms are subject to the law applicable in French Polynesia.

For any question or complaint relating to a donation, the donor may contact the Association at: support@coralgardeners.org

The parties will endeavor to seek an amicable solution to any dispute before initiating proceedings.

Failing an amicable resolution, and subject to any applicable mandatory rules of jurisdiction, any dispute shall be submitted to the competent courts of French Polynesia.
